Terms and Conditions of your IHL Membership

  1. Membership 1.1. Your membership will begin on the day you join. 1.2. When paying by Direct Debit, an initial pro-rata payment will be required to cover the period up to your first DD payment. 1.3. Your membership is personal to you. You cannot transfer it to another person. 1.4. If Go Cardless on behalf of Inspiring Healthy Lifestyles or the bank/building society makes a mistake with your Direct Debit payment you are guaranteed a full and immediate refund from your bank/building society.
  2. Our Communications With You 2.1. Inspiring Healthy Lifestyles works with Go Cardless to collect our Direct Debit payments.
    2.2 Inspiring Healthy Lifestyles will endeavour to give 14 days advance notice of changes to prices. Communications of these changes will be displayed within our facilities. 2.3 Go Cardless will notify you of changes to your Direct Debit in line with their Direct Debit guarantee with you 3 days in advance of any change.
  3. Fees 3.1. You must pay a monthly membership determined by your chosen membership package. 3.2. Monthly instalments will be due on either the 1st of each calendar month or the next available working day by Direct Debit. 3.3. Inspiring Healthy Lifestyles reserves the right to amend your monthly payments and you will be notified before any changes take place. We may change the amount of your monthly payments. 3.4. Monthly fees are payable even if you do not use your membership.
  4. Cancelling Your Membership 4.1. Memberships cannot be cancelled prior to the agreed contract period. A contract may be cancelled once the final payment has been made; this requires 30 days’ notice in writing to us or GoCardless. 4.2. Limited Right to Cancel 4.2.1. If we fail to maintain the standard of service that you would reasonably expect. 4.2.2. If we alter the operating hours of the service unreasonably. 4.2.3. If you develop a medical condition which prevents you for using the services on an ongoing basis. An appropriate medical practitioner must provide written evidence. 4.2.4. If you move away from the area by a distance which we consider, at our sole discretion, to be too far to travel to the services for regular use. Evidence will be required. 4.2.5. If you lose your employment and are unable to keep up the repayments as a result. You must produce documentary evidence and initially we will suspend payments for two months, and review with you your financial situation thereafter.
  5. Before you use our gyms 5.1. For your safety, we require you to have an induction with our team or alternatively to watch our online gym waiver video before using our gym facilities. This also includes satisfactory completion of the Physical Activity Readiness Questionnaire. This will ensure that you are well enough and prepared enough to use the gym facility. 5.2. If you would like to book an induction, please contact your desired site/s and check availability before attending. 5.3. All of our centres other than Tadcaster use the Technogym Wellness System. You can access this via a free app or alternatively via a physical key which would be an additional cost. 5.4. If after completing the Physical Activity Readiness Questionnaire we consider that your health may be affected in any way by the use of our facilities, you may be advised to go through our Activity Referral Scheme.
  6. Etiquette When Using Our Facilities 6.1. You must comply with all customer codes of conduct / rules and / or etiquette forming part of the membership agreement. 6.2. Inspiring Healthy Lifestyles reserves the right to make amendment to any customer code of conduct / rules/etiquette at any time. Any changes will be displayed within our facilities.
  7. Changing this Agreement 7.1. Inspiring Healthy Lifestyles reserves the right to amend our membership agreement at any time. You will be notified in writing before any changes take place.
  8. Facilities 8.1. You are only entitled to use the facilities available outlined in your membership package. 8.2. You are required to pay additional charges to use certain other facilities/activities within our centre(s). 8.3. Facilities/Courses may open/close earlier on public holidays. Facilities may also close for occasional special events. Notices will be sent via the OpenPlay booking system in advance notifying customers of any changes. No refunds will be available for these periods. 8.3.1. We may change our opening times or withdraw any of the facilities at any time if we need them for events, tournaments, exhibitions, or other special activities. 8.3.2. We may need to close a facility or part of it for repair/refurbishment on the grounds of health and safety or improving customer service. Fitness classes may be cancelled due to unforeseen circumstances. If this occurs, we will endeavour to: • Send cancellation information via the OpenPlay booking system, giving as much notice as practically possible. • Arrange alternative facilities (if possible) during a period of closure. 8.4. Your membership gives you 8 days priority booking over non-members but does not guarantee the availability of activities. 8.5. Inspiring Healthy Lifestyles management reserves the right to change the activity programme. Prior notice of cancellations/new sessions will be always be given with as much notice as possible. 8.6. Promotions do not apply to existing members. 8.7. Where swimming is included in your membership, swimming is limited to public sessions only. Please refer to the individual centre’s for available times.
  9. Membership Account 9.1. You must use your membership when accessing facilities; otherwise, we will charge you the standard rate. 9.2. All members must have a photograph taken for their membership for identification purposes; this will be stored on Inspiring Healthy Lifestyles database. This information will be solely used by us and not any third parties.
  10. Additional Proof for discounted memberships 10.1. Appropriate proof will be required from any Member in order to establish eligibility for a discounted Membership (the accepted forms of proof are listed below in points 10.2 – 10.7). Should appropriate evidence of eligibility not be provided 4 weeks from the joining date, then Inspiring Healthy Lifestyles may upgrade your membership to the Peak membership rate prevailing at that time. Eligibility for discounted memberships may be reviewed upon renewal or at any time during the membership period. Any necessary subscription amendments will be made after giving notice in writing before the changes take place. 10.2 For Junior and Teen memberships, the member must be the correct age for each membership type. For Junior this is ages 5 – 13 years, for Teen this is ages 14 – 15 years at the time of joining. Proof in the form of a birth certificate or passport should be provided. As the person gets older and moves out of the age bracket for their membership type, Inspiring Healthy Lifestyles will amend the membership access to incorporate these new changes and will amend the price to suit the new category. Any necessary subscription amendments will be made after giving notice in writing prior to the changes taking place. Please note that 14 to 15-year-olds are only permitted to use our gyms between the hours of 12.00 and 18.00 daily, inclusive of school holidays (weekends from 12.00 until close). 10.3 For Student memberships, the member must be in full time education or a full time apprentice. Proof should be provided in the form of a letter from college or learning institute (in which it shows the member is studying full time or is in a full time apprenticeship scheme) as well as photographic ID (Student card/driving licence/Passport). 10.4 For Corporate memberships, the member must be currently working at any of the companies in receipt of corporate discount within Inspiring Healthy Lifestyle leisure centres. To check if your company qualifies, please contact your chosen site. Proof should be provided in the form of your most recent payslip (within the last 3 months) with your company name and logo clearly visible. 10.5 For Wellbeing membership, the member must be referred onto this membership from our Wellbeing Team and be in receipt of a branded dated letter from the team stating what scheme they have been referred this membership from. 10.6 For Well at Work memberships, the member must be a paid employee of Cannock Chase Council. Proof must be brought to the leisure centre of choice in the form of a recent payslip (within the last 3 months) that is branded with the company logo and must state which department they work for within the company.
  11. Technogym/My Wellness To allow you to make the most of your membership in our gym facilities, we use the Technogym MyWellness System at all our centres other than Tadcaster. This system allows you to track your progress and follow a personalised programme set by our team (or yourself) quickly and easily. The data that you enter is stored by Technogym and is used to record your activities within the gym. You can delete your MyWellness account at any time, but in doing so, you will not be able to use the products and services specified above. By signing up to a MyWellness account you are agreeing to allow Technogym to process the below information: • Your ordinary personal data (contact details, email address). • Personal details belonging to special categories, specifically: data about your health which is necessary for the provision and proper functioning of the My Wellness Service. • Details of your geographical location. Minors using Technogym Wellness System People under the age of 16 (minors) may only use the Service under the supervision of the person holding parental authority over them (parents or guardians). Minors may only register for the Service with consent from their parent(s) or guardian(s). Minors may register for the Service by providing the e-mail address of one of their parents or guardians. Technogym will send an e-mail to the parent or guardian’s address asking them to authorise the Minor’s registration. Only once this consent has been granted may the Minor’s registration to the Service be completed. Technogym does not knowingly collect any information or data on Minors and does not allow them to register without Parental Consent. If Technogym discovers that any data collected in the Database relates to a Minor and that it was collected without valid Parental Consent, Technogym will delete this data at the earliest opportunity possible.
